THE EFFECTS OF THE PROVISIONS OF THE LAND USE ACT ON CUSTOMARY LAND OW
Abstract
This study evaluates the effects of the provisions of the Land Use Act of 1978 on customary land ownership in Nigeria. The Act, which vested all land in each state in the hands of the Governor to be held in trust for the people, has significantly altered traditional land tenure systems. The research explores how the Act has impacted indigenous rights, communal ownership, and access to land for socio-economic development. Findings reveal that while the Act was intended to streamline land administration and promote equitable access, it has often led to conflicts between statutory law and customary practices, weakened community control over land, and created challenges in securing tenure. The study concludes that harmonizing statutory provisions with customary land rights is essential for ensuring fairness, reducing disputes, and promoting sustainable land management in Nigeria.
