Abstract

ABSTRACT This research examines the persistent issue of oil spillage in Nigeria's Niger Delta, a region vital to the nation's economy but severely affected by decades of oil exploration and production. Recurring spills, totalling over 754,000 barrels between 2006 and 2022, primarily from sabotage, theft, and operational failures compounded by aging infrastructure, make it one of the world's most polluted regions. These spills result in devastating environmental damage, including contamination of water, soil, and air, and loss of biodiversity. Impacts on communities are severe, leading to significant health risks, decimated livelihoods like farming and fishing, and damage to property. Despite existing legal and institutional frameworks, effective management is significantly challenged. Key issues include legislative gaps, weak enforcement mechanisms often lacking independence and resources, conflicts of interest, and a significant lack of accountability and transparency, notably in oil spill data reporting and the flawed Joint Investigation Visit process. This study critically analyses these frameworks and challenges, aiming to identify gaps and propose comprehensive reforms to enhance the effectiveness of oil spillage management, promote environmental justice, and support sustainable development in the Niger Delta.
