LEGAL AND INSTITUTIONAL FRAMEWORK FOR ENVIRONMENTAL POLLUTION CONTROL IN NIGERIA
Abstract
This paper examines the legal and institutional framework established in Nigeria for the
control of environmental pollution. Nigeria, like many developing nations, faces significant
environmental challenges stemming from industrial activities, urbanization and inadequate
waste management practices. The study explores key legislation, such as the National
Environmental Standards and Regulation Agency(NESREA) Act and the Environmental
Impact Assessment Act, which provide the legal basis for environmental protection and
pollution control. Additionally, it analyzes the roles of various government agencies and
institutions tasked with enforcing these laws, including NESREA, the Federal Ministry o f
environment and state environmental protection agencies. Furthermore, the paper discusses
the challenges and limitations of the current framework, such as inadequate enforcement
capacity, insufficient public awareness and limited funding. Recommendations are proposed
to strengthen the effectiveness of environmental regulations, including capacity building for
enforcement agencies, public education campaigns, and increased collaboration between
government industry and civil stakeholders. By enhancing regulatory compliance and
promoting sustainable environmental practices, Nigeria can mitigate the adverse impacts of
pollution and safeguard public health and ecological integrity for future generations.
