AN ANALYSIS OF THE DOMINO EFFECT OF POWER TUSSLE AMONGST LAW ENFORCEMENT AGENCIES ON THE NIGERIAN CRIMINAL JUSTICE SYSTEM
Abstract
ABSTRACT
The effectiveness of the Nigerian criminal justice system is being undermined by a perceived power struggle amongst law enforcement agencies. This phenomenon has led to clashes amongst these agencies, hindering the smooth administration of justice. This study aims to investigate the existence, causes, and effects of this power tussle, and propose solutions to mitigate its negative impacts. Using a doctrinal legal research methodology, this study examines the legal framework governing law enforcement agencies in Nigeria, including their roles, responsibilities, and relationships. The research reveals that the power tussle amongst law enforcement agencies is indeed a reality, fueled by factors such as poor communication, inadequate training, and unclear boundaries of authority. The effects of this power struggle are far-reaching, leading to delays and miscarriages of justice, erosion of public trust, and increased crime rates. The study also identifies the need for a more coordinated and collaborative approach amongst law enforcement agencies, as well as the establishment of clear guidelines and protocols for their operations. Based on the findings, this study recommends the implementation of measures to address the power tussle, including the establishment of a central coordinating body, regular training and capacity building programs, and the development of a comprehensive legal framework that clarifies the roles and responsibilities of each agency. The study concludes that addressing the power tussle amongst law enforcement agencies is crucial to ensuring the effectiveness and efficiency of the Nigerian criminal justice system.
