Abstract

This study examined the legal challenges and remedies for environmental pollution caused by corporate activities in Nigeria. The study focused on identifying the legal frameworks governing environmental protection in Nigeria; analyze the legal challenges in enforcing environmental laws against corporate entities; examine the role of regulatory agencies in combating corporate environmental pollution; and examine legal remedies for environmental pollution caused by corporate activities in Nigeria. The study identified several critical challenges that hinder effective management of corporate-induced environmental pollution. Existing legislation suffers from outdated provisions and regulatory gaps, failing to address emerging issues like e-waste and microplastics. Enforcement is weakened by corruption, insufficient resources, and a lack of skilled personnel, resulting in poor compliance monitoring and lenient sanctions. Proposed remedies from the analysis include strengthening legislative frameworks by updating laws and incorporating international standards, enhancing enforcement through increased funding and inter- agency coordination, and promoting corporate accountability via mandatory reporting and stricter penalties. Facilitating access to justice for affected communities through legal aid and alternative dispute resolution mechanisms was also highlighted as essential. In essence, this study underscores that while Nigeria possesses a foundational legal and institutional structure to combat environmental pollution from corporate activities, significant reforms are needed to overcome the identified challenges and ensure effective remedies. The study concluded by identified legal challenges including outdated laws, weak enforcement, corporate irresponsibility, and barriers to justice that perpetuate this crisis, alongside the potential remedies to address them. While Nigeria’s legal and institutional frameworks provide a starting point, their effectiveness that allow pollution to persist unchecked, particularly in vulnerable regions like the Niger Delta. The study recommended that government should update and harmonize environmental legislation to reflect contemporary challenges. This involves amending statutes like the Environmental Impact Assessment Act and the NESREA Act to include provisions for emerging pollutants such as e-waste and microplastics.
