Abstract

ABSTRACT The problem from oil exploration in the Niger Delta has brought to light the gaps in environmental legislations in Nigeria. The aim of this project is to examine the effectiveness of the Environmental Regulation in Nigeria in the Oil and Gas Sector. The research takes into account the following objectives. It identified the extant environmental regulatory mechanism in the Oil and Gas Sector in Nigeria. It assessed the effectiveness of environmental regulation in the Oil and Gas Sector in Nigeria. It identified the environmental regulation in the Oil and Gas Sector in Nigeria. We will utilize the doctrinal method of research in discussing the various concepts in the course of this project. The findings of the research indicate that the regulatory framework in Nigeria consists of both legislations and institutions. The legislations include the 1999 Constitution of the Federal Republic of Nigeria as amended, PIA 2021, NOSDRA Act 2006, NESREA Act, EGASPIN 2018 and other similar legislations. The Constitution is the core legislation for environmental regulation. Section 20 of the constitution recognizes the significance of the environment. We also found that environmental regulations have been enforced through the following means. This includes Inspection and Searches, arrest, Permit, Licence and Certificate Forfeiture, Sealing and Seizure, Civil Liabilities and Criminal Prosecution. However, in my view the CFRN should be amended, especially pertaining to the aspect of environmental law. There have been notable achievements in environmental regulation. We found that there are significant barriers to environmental regulation in the oil and gas industry. The lack of environmental data indicates that the minimum acceptable standards and ambient values set by the NESREA regulation are essentially fabricated Not grounded in empirical study. Based on the findings, we propose the following recommendations. The Legal Framework for Environmental Protection should be strengthened. There should be strict penalties for violation of environmental regulations. An environmental court should be established. In addition, a Centralized legal instrument should be enacted for Oil pollution. An international best practice should be adopted. Lastly, community engagement should be encouraged.
