Abstract

This research undertook a critical examination of the legal framework governing data privacy in Nigeria, with a specific focus on its efficacy in preventing and addressing cybercrime. This ersearch argued that the existing legal framework failed to provide adequate safeguards for the protection of personal data, thereby exacerbating the risks associated with cybercrime, including identity theft, financial fraud. and reputational damage. The protection of data privacy has hocome a pressing concern in Nigeria, as cybercrime continues to escalate at an alarming rate The country's existing legal framework lacks robust provisions to safeguard personal data and hold perpetrators accountable. Through a doctrinal analysis of relevant statutes, judicial decisions, and regulatory instruments, this study identified significant lacunae in the country's data protection regime Tin address these shortcomings, the study proposes a comprehensive data protection framework that prioritizes the principles of data minimization, purpose limitation, data subject consent, and data protection by design and default. The proposed framework also advocates for the establishment of an independent data protection authority, the implementation of robust cybersecurity measures, and the enhancement of public awareness and education through capacity-building programs and public outreach initiatives. The findings and recommendations of this study are intended to inform policy and regulatory retorms, ultimately promoting a safer and more secure cyber environment in Nigeria, and enhancing the country's compliance with international data protection standards. By addressing these gaps and weaknesses. Nigeria can effectively combat cybercrime and ensure the confidentiality, integrity, and availability of personal data
