Abstract

Intellectual Property (IP) Rights grant creators and innovators exclusive control over their intangible creations, enabling them to benefit from their work and investments. The rights of IP owners encompass a range of legal entitlements, including the right to reproduce, distribute and display their work. They also have the right to prevent unauthorized use, reproduction, and distribution of their work, and to seek legal remedies for infringement. The Copyright Act, Trademarks Act and Patent and Designs Act are the Primary legislation on Intellectual Property in Nigeria. There are other Nigerian Legislation including the Nigerian Constitution that protect the Rights of Owners in Intellectual Property. However, owners of Intellectual Property are not fully aware of their rights and remedies available to them when these rights are infringed and this causes a problem in enforcing such rights. This research is aimed at educating owners about their Intellectual Property Rights and the remedies for their infringement. The research methodology used in this research work is doctrinal as books, journal articles, legislation, judicial authorities as well as internet sources have been used as reference materials. In this research, it has been found that Intellectual property rights are protected under Nigerian laws and international instruments. The Intellectual Property Laws of Nigeria are similar to those of other jurisdictions and there are institutions that help to safeguard Intellectual Property Rights and provide remedies when they have been infringed. It is recommended that,Intellectual Property owners need to be aware of their rights under Nigerian Laws and international agreements to protect these rights effectively. Nigeria's Intellectual Property Laws need updating to meet international standards and align with similar jurisdictions.Intellectual Property owners should take legal action when their rights are infringed, and courts should grant both adequate and deterrent remedies to prevent future infringements
