EVALUATION OF THE THEORY OF SEPARATION OF POWERS OF POWERS IN JOCK LOCKE AND THE NIGERIAN SITUATION
Abstract
The theory of John Locke’s separation of powers means that a different body of persons is to administer each of the three departments of government. That no one of them is to have a controlling power over either of the others for the purpose of preserving the liberty of the individual and for avoiding tyranny separation of powers is necessary. In Nigeria, how has this Theory been effective either during the military rules or the civilian administrations? This study is going to examine the wrong of separation of powers in Nigeria. The objectives of the study designed by the researcher include: discussing the various variants of separation of powers, examining other thinkers' criticism of separation of powers, discussing the change and issue in Separation of powers in Nigeria, examining some views and thoughts on Separation of powers as well as highlight the anti- naturalistic and pro- naturalistic doctrine of separation of powers. Based on the finding of the research the researcher recommended that Locke's piecemeal social engineering is an ideal recipe to Separation of powers, where by small and reversible change are made to society.
