THE EFFECT OF TRIAL WITHIN TRIAL IN A CRIMINAL PROCEEDING IN NIGERIA
Abstract
ABSTRACT
This research critically examines the role and impact of trial within trial in the Nigerian criminal justice system. Trial within trial, also known as "voire dire" (to speak the truth), is a procedural safeguard used to determine the voluntariness of confessional statements before their admissibility in court. While this mechanism is intended to protect defendants from coercion, undue influence, and forced confessions, it has also been criticized for contributing to judicial delays, case backlogs, and inefficiencies within the legal system.
The study explores both the benefits and drawbacks of trial within trial, assessing its effectiveness in upholding fair trial rights while highlighting its implications for justice delivery. Through an analysis of legal authorities, case law, and statutory provisions, the research traces the historical roots of this practice, its adaptation from British colonial law, and its current application in Nigeria. The research further investigates the procedural complexities associated with trial within trial, including its potential for misuse by defense counsel to delay proceedings and frustrate prosecution efforts.
In light of these concerns, the study also examines judicial reforms and legislative interventions aimed at addressing the inefficiencies of trial within trial. The research evaluates ongoing debates on its possible abolition or modification, weighing the need for procedural safeguards against the imperative for expedited justice. It also considers the divergent views of legal experts, some of whom argue that trial within trial remains a necessary tool for safeguarding defendants' rights, while others advocate for alternative mechanisms to ensure fair trial standards without causing unnecessary delays.
This study provides a comprehensive analysis of the trial within trial mechanism and its broader impact on the Nigerian legal system. The findings contribute to discussions on legal reforms and suggest measures for improving the efficiency of criminal justice administration in Nigeria. Ultimately, the research aims to inform policy recommendations that strike a balance between protecting defendants' rights and ensuring the swift dispensation of justice.
