BALANCING NATIONAL SECURITY AND DIGITAL PRIVACY IN NIGERIA
Abstract
This study examines the complex interplay between national security and digital privacy in Nigeria,
highlighting the legal, technological, and policy challenges inherent in achieving a sustainable balance between state safety and individual liberties. In the face of evolving existential threats such as terrorism, cybercrime, banditry, and political unrest, the Nigerian state has increasingly relied on surveillance, cyber monitoring, and data interception measures which, while essential for public safety, raise significant concerns regarding individual privacy, freedom of expression, and data protection. The primary aim of this research is to create a balance between national security and digital privacy in Nigeria, focusing on identifying ways that can ensure the protection of citizens’ personal data in a time where technology exposes sensitive information while maintaining security measures and highlighting implications, challenges and legal frameworks for harmonization. To achieve this, the study adopts a doctrinal and comparative research methodology, involving a comprehensive analysis of statutory frameworks including the Cybercrime (Prevention, Prohibition) Act, 2015, the Nigeria Data Protection Act, 2023, and the General Application and Implementation Directive (GAID), 2025. This methodology is further supported by a qualitative review of institutional mechanisms, assessing the operational capacity of the Cybercrime Advisory Council, the Nigeria Data Protection Commission, and various security agencies tasked with digital monitoring. The research identifies critical bottlenecks, such as insufficient technical expertise among judicial officers, inadequate digital-forensic infrastructure, weak independent oversight, and dangerously ambiguous legal definitions of “national security” that compromise the proportionality and necessity of surveillance activities. The study concludes that achieving an effective equilibrium requires multi-stakeholder collaboration, intensive capacity-building in digital forensics, clear legislative definitions to limit discretionary power, and the establishment of transparent, independent oversight bodies. By adopting a harmonized framework that integrates security imperatives with robust privacy protections, Nigeria can strengthen its national resilience against emerging cyber threats while simultaneously safeguarding the democratic principles and digital freedoms of its citizens.
