THE DEFENCE OF PROVOCATION AS A MITIGATING FACTOR TO MURDER IN SOUTHERN NIGERIA.
Abstract
In a comprehensive approach to establishing the defence of provocation as a mitigating factor in murder cases in Southern Nigeria. It is important to prove provocation as a fact in order for the court to evaluate the extent of provocation that led to the crime, taking into account the impact of intense emotions and behaviors. However, issues such as subjectivity and gender biases can arise. Further research is needed to assess the effectiveness and fairness of the provocation defence and explore potential reforms. This study aims to analyze the provocation defence in Southern Nigerian case law, examine legal frameworks, and consider cultural and social influences. The research methodology used is doctrinal, incorporating primary and secondary legal sources. While the defence does not absolve guilt, it does mitigate punishment severity. It is important to substantiate the defence with evidence and not rely on weak foundations. Reconsidering the proportionality rule, considering individual characteristics, and aligning Nigerian law with local statutes can ensure a fair and impartial legal system. Recognizing the provocation defence as a mitigating factor in murder cases can contribute to a more equitable legal system that considers social and cultural influences. Rectifying shortcomings in the current d establishing appropriate criteria for thelegal framework an defence is essential.
