CHALLENGES TO OIL AND GAS LITIGATION IN NIGERIA
Abstract
Oil and gas exploration and extraction in Nigeria presented a complex web of issues, particularly concerning environmental protection and the socioeconomic development of the host communities. Disputes often arose among various stakeholders, including multinational corporations, government agencies, local communities, and indigenous peoples, regarding issues such as land rights, revenue allocation, environmental pollution, and corporate accountability. These conflicts frequently escalated into protracted legal battles, with significant implications for investment, governance, and human rights. This study aimed to examine the multifaceted challenges in oil and gas litigation in Nigeria. The study adopted a doctrinal research design and made use of primary and secondary data. The sources of primary data were statutes and case law relevant to oil and gas litigation in Nigeria, while the sources of secondary data included relevant textbooks, journal articles, and materials from the Internet. Data collected were subjected to content analysis to arrive at the findings and recommendations of the study. The study found that Nigeria's oil and gas sector faces significant challenges in community relations, environmental compliance, security, and regulatory instability, leading to frequent legal disputes. It recommended strengthening the regulatory framework, enhancing community engagement, improving environmental compliance, boosting security measures, and promoting arbitration and ADR mechanisms to reduce litigation and create a more stable environment for sustainable development and investment.
