Abstract

Nigeria's oil and gas industry is the lifeblood of the nation's economic well-being. Hydrocarbon reserves have propelled the country to the forefront of the global energy market, generating substantial revenue, foreign exchange earnings, and fostering overall economic development. However, the intricate nature of oil and gas exploration, production, and distribution necessitates a robust legal framework to ensure transparency, sustainability, and equitable benefits for all stakeholders. This dissertation delves into the intricate legal labyrinth governing Nigeria's oil and gas industry, with a particular focus on critically appraising its effectiveness in addressing contemporary challenges and promoting sustainable development. It shines a spotlight on the Petroleum Industry Act 2021 which seeks to provide legal, governance, regulatory and fiscal framework for the Nigerian Petroleum Industry. The cornerstone of this analysis is a comprehensive examination of five critical shortcomings within the current legal framework. These shortcomings pose significant roadblocks to the industry's sustainable growth. The primary concern lies in the lack of clarity within the regulatory landscape as well as ambiguities that hinder effective oversight, thereby jeopardizing industry compliance and the overall stability of the sector. This dissertation adopts a doctrinal research approach. This methodology delves deep into the existing legal framework, meticulously dissecting relevant legislation, judicial pronouncements, and regulatory instruments that govern the Nigerian oil and gas industry. By meticulously analyzing these legal instruments, the study aims to illuminate their strengths and weaknesses, ultimately paving the way for a more comprehensive understanding of the current legal landscape. The urgency for a more adaptable and responsive legal system in Nigeria cannot be overstated. Such a system would not only attract crucial international capital but also ensure environmental sustainability and enhance overall industry productivity. As the nation strives to diversify its economy, a thorough review and potential revision of the laws governing the oil and gas sector should be a top priority. This dissertation advocates for a collaborative approach. Stakeholders, policymakers, and industry leaders must work together to address the identified deficiencies. By fostering a collective effort, a new era of legal governance for the oil and gas industry can be ushered in, one that aligns with global best practices and fosters sustainable development for the benefit of future generations.
