CRITICAL APPRAISAL OF THE METHODS OF APPOINTMENT OF JUDGES IN NIGERIA
Abstract
This research provides a critical appraisal of the methods and procedures for the appointment of judges in Nigeria, with a particular focus on the constitutional, conceptual, legal and institutional frameworks guiding the process. The research interrogates the role of key bodies such as the National Judicial Council (NJC), the executive arm of government, and the legislature in judicial appointments under the 1999 Constitution of the Federal Republic of Nigeria (as amended). It examines whether the existing process adequately ensures merit, transparency, independence, and the rule of law.The study highlights the delicate balance between the independence of the judiciary and the influence of the political branches in judicial appointments. It critically evaluates the effectiveness of the NJC in safeguarding judicial integrity while pointing out areas where executive discretion may compromise judicial impartiality. Drawing from comparative insights in other jurisdictions, the work explores alternative models of appointment that could enhance Nigeria's judicial credibility and public confidence.Furthermore, the thesis discusses the implications of ethno-regional politics, gender disparity, and lack of accountability in the current system, offering reform-oriented recommendations to strengthen the quality and independence of the Nigerian judiciary. The research concludes that while the Nigerian system of judicial appointment has constitutional backing and some institutional safeguards, it remains susceptible to political manipulation and lacks full transparency. The study calls for reforms to ensure that appointments are based strictly on merit, integrity, and competence, in order to uphold the ideals of justice and democratic governance.
